Terms and Conditions

Thanks for visiting Jared The NYC Tour Guide®. These Terms and Conditions explain how tour bookings, payments, cancellations, itinerary changes, and day-of logistics work. The idea is to keep things clear and fair, so you know what to expect and Jared can focus on giving you a smart, memorable day in New York City.

1. Using This Website and Booking a Tour

These Terms and Conditions apply to your use of this website, to tour inquiries, and to any booking or participation in a tour with Jared The NYC Tour Guide®. By using the site, contacting Jared, submitting a booking request, or taking a tour, you agree to these terms.

2. Nature of the Service

Jared The NYC Tour Guide® offers private and custom New York City tours for individuals, families, schools, and groups. Tours may include walking tours, museum tours, neighborhood tours, coach or step-on tours, and custom itineraries built around your interests and schedule.

Most tours are private rather than public scheduled tours. Jared will work with you to shape the route, pacing, meeting point, and overall plan based on your group, the time available, and what you most want to see.

3. Booking and Confirmation

Sending a request through the website, by email, or by phone does not by itself reserve a tour date. A tour is confirmed only after availability has been checked, the main details have been agreed upon, and any required payment has been received.

Jared may ask follow-up questions before confirming the booking. That is part of how the tour gets tailored to your group.

4. Pricing and Payment

Tour pricing depends on the particular experience being arranged. Factors can include length of tour, group size, logistics, whether the tour involves a museum or multiple locations, and whether extra planning is needed in advance.

A quote is given for the details discussed at the time of booking. Availability is not locked in until the booking is confirmed. Payment may be required in full to reserve the tour, unless another arrangement is specifically agreed to in writing.

Jared will let you know the price for your requested tour before anything is finalized. If the plan changes in a meaningful way, the quote may change too.

In some cases, extensive pre-tour planning, unusual coordination, or repeated itinerary revisions may be billed separately. If that becomes necessary, it will be discussed in advance.

5. Tickets, Admission Fees, Transportation, Food, and Other Costs

Unless expressly included in writing, the tour fee covers Jared’s guiding services and not outside expenses. Museum admission, attraction tickets, public or private transportation, taxis, rideshares, food, drinks, souvenirs, gratuities to third parties, and similar out-of-pocket costs are the guest’s responsibility.

If a tour includes a museum or other attraction, ticket prices and admission rules are controlled by that venue and may change without notice. Jared is not responsible for third-party pricing changes, closures, timed-entry rules, or venue restrictions.

6. Cancellations, Refunds, and Rescheduling

Tour time is reserved in advance, so cancellations affect scheduling in a real way. For that reason, cancellations made up to one month before the tour date are fully refundable. Cancellations made after that point but up to four days before the tour date are 50% refundable. Cancellations made within four days of the tour date are non-refundable.

If Jared agrees to reschedule instead of canceling, any amount already paid may be applied to the new date. Rescheduling depends on availability and cannot be guaranteed.

If guests do not show up, arrive so late that the tour cannot reasonably proceed as planned, or leave early by choice, refunds are not guaranteed.

7. Weather, Delays, and Changes Beyond Reasonable Control

Tours usually operate in normal New York City weather, including ordinary rain or cold. Rain by itself does not cancel a tour. If conditions become hazardous or genuinely unsafe, the tour may be shortened, rerouted, postponed, or rescheduled.

Streets close, trains run late, museums change hours, crowds build, and the city does what the city does. Because of that, Jared may need to adjust the route, the order of stops, the pace, or the exact meeting and ending plan. He will make reasonable efforts to preserve the spirit and value of the experience even when the exact path changes.

8. Itineraries Are Custom, but Not Guaranteed Stop-by-Stop

Custom planning is part of what makes these tours special, but no exact stop list, sequence, timing window, or venue access can be guaranteed unless specifically confirmed in writing. The city is dynamic, and itineraries sometimes have to change because of weather, crowds, closures, transportation issues, construction, safety concerns, or other circumstances outside reasonable control.

Jared will use his judgment to make good substitutions when needed and to keep the experience thoughtful, engaging, and worthwhile.

9. Coach Tours and Large Groups

For coach or step-on tours, a working sound system is required, along with two contiguous seats near the microphone. Larger groups should also have a group leader who knows the guests and can help keep the day moving smoothly. The driver should be professional and able to communicate in English.

If the setup is materially different from what was agreed or is not workable or safe, Jared may need to modify or decline the tour format.

10. Guest Responsibilities

Guests are expected to arrive on time, dress appropriately for a walking city and the day’s weather, communicate meaningful mobility or health concerns ahead of time when possible, and treat Jared, venue staff, and others with respect.

Parents, guardians, teachers, and group leaders remain responsible for the supervision and behavior of minors in their care. Guests are also responsible for their own belongings during the tour.

Jared may end a tour without refund if a guest’s conduct is abusive, threatening, illegal, dangerously disruptive, or creates a serious problem for the group, the guide, or a venue.

11. Accessibility, Mobility, Health, and Pace

Many tours involve walking, standing, stairs, crowds, curbs, uneven sidewalks, weather exposure, and shifting city conditions. Guests should use their own judgment about whether a particular tour is a good fit.

Jared will make reasonable efforts to accommodate known accessibility, mobility, or pacing needs when they are shared in advance. Even so, not every route, station, neighborhood, or venue can be made fully accessible.

12. Personal Safety and Ordinary Touring Risks

New York City is a large, active, unpredictable place. By taking part in a tour, you understand that ordinary city touring carries normal risks, including traffic, crowds, changing weather, uneven walking surfaces, stairs, and transit-related conditions. Guests participate at their own risk and remain responsible for their own conduct, awareness, personal decisions, and belongings.

13. Limitation of Liability

To the fullest extent permitted by law, Jared The NYC Tour Guide® is not liable for delays, closures, losses, injuries, expenses, or damages arising from third-party acts or omissions, venue or transportation changes, weather events, force majeure, guest lateness, guest health issues, or other circumstances outside reasonable control.

Nothing in these Terms is intended to waive any rights that cannot legally be waived under applicable law.

14. Third-Party Platforms, Listings, and Reviews

Jared The NYC Tour Guide® may appear on TripAdvisor and other third-party platforms, directories, social media pages, review sites, or booking-related services. If you book through a third-party platform, that platform’s own payment terms, cancellation rules, privacy practices, and dispute procedures may also apply.

References on this website to outside platforms, badges, reviews, listings, or awards are for informational and promotional purposes. Jared is not responsible for the content, uptime, or policies of third-party websites.

15. Reviews and Testimonials

Reviews and testimonials shown on this website or on third-party platforms reflect individual experiences and opinions. They are not a guarantee that every guest will have the exact same experience.

16. Photos and Promotional Use

Guests are welcome to take personal photos during tours unless a venue prohibits it. Jared may occasionally take or request photos for business or promotional use. If you prefer not to appear in photos, just say so at the beginning of the tour and Jared will respect that.

17. Website Content and Intellectual Property

The text, branding, tour descriptions, page design, and other original content on this website are owned by or used with permission by Jared The NYC Tour Guide®, unless otherwise stated. They may not be copied, republished, or commercially reused without permission.

You may use this website only for lawful purposes and not in any way that interferes with the operation of the site or misuses its content.

18. Governing Law and General Legal Terms

These Terms and Conditions are governed by the laws of the State of New York. If any part of these Terms is found unenforceable, the rest will remain in effect. Jared The NYC Tour Guide® may update these Terms and Conditions from time to time, and the version posted on this website will be the current version.
